Bestway USA, Inc. is facing a class action lawsuit following a recall of approximately 866,000 AirJet and HydroJet spa pumps in September 2024. The recall was initiated due to a defect that can cause the pumps to overheat, potentially igniting the plastic housing and posing a significant fire hazard. The U.S. Consumer Product Safety Commission (CPSC) reported three fires linked to the faulty pumps, including one fatality, with seven additional incidents under investigation.
The lawsuit alleges that Bestway breached the implied warranty of merchantability, claiming the recalled spa pumps are unfit for their intended purpose and present a fire and burn risk. The plaintiffs argue that Bestway concealed or failed to disclose the manufacturing defects, leaving consumers with unsafe and unusable products, resulting in economic losses. The complaint states that Bestway did not disclose the potential overheating hazard associated with the recalled spa pumps.
The CPSC urges consumers to immediately discontinue use of the recalled AirJet and HydroJet spa pumps, which were often sold with inflatable spa liners under brand names such as SaluSpa, Coleman, and Hydro-Force. Bestway is offering a free replacement pump or a refund of $100 for AirJet models and $189 for HydroJet models.
The recall encompasses AirJet and HydroJet spa pumps with model numbers P05332, P05339, P05711, P05807, P07000, P07001, P05511, P07034, and P07572. These model numbers are printed on a label located on the side or back of the pump, along with the “Bestway” brand name. The affected spa pumps were sold between May 2021 and May 2024 at major retailers including Amazon, Costco, Walmart, Sam’s Club, and QVC, with prices ranging from $400 to $790.
Consumers can determine if their spa pump is included in the recall by visiting the designated recall website. The class action lawsuit seeks to represent all U.S. consumers who purchased a recalled Bestway spa pump between May 2021 and May 2024. This legal action aims to address the negative Bestway Spa Recall Experience of consumers who purchased the defective pumps.
